Legal Question in Family Law in California

bigamy

My friend married a woman and then seperated after 3 months. When he told her he wanted a divorce, she told him that their marriage isn't legal, because she is still married to someone else. Does this marriage need to be legally dissolved?

Since this other individual is far less than credible, I would recommend your friend file to nullify the marriage to make certain he is covered in future. If she lied once, may have again. Don Holben 800-685-6950

Based upon the information that you have given, your freind is not married. However, your freind should file for a nullity because he may find out in the future that she lied and that she was single, which means the his marriage was valid. If he has the marriage declared an nullity by the court, then he is single, no doubts. She lied once, she may have lied twice. Good Luck, Pat McCrary
