Legal Question in Family Law in California

Bigotry -

My brother married a gal on parole only to find out that she was still married to someone else. (She married him so she could be paroled in his county). Their relationship is breaking up and he doesn't know what to do. Since their marriage is not legal, does he have to file for divorce or an annulment?

Also, they have a child together and the mom is going back into a residental drug program. My brother wants to move away from her and her issues with their child. Since he is the father, does he have to get any special court permission to leave the county that they are living in?
