Legal Question in Family Law in California

Biological Custody

I found out i have a 6 year old daughter from a former girlfriend through paternity tests. The parents of the guy that thought he was the father has custody of the little girl. My question is Would i be able to go to court and take custody from them??? And how hard it would be to do so??

Re: Biological Custody

You can file a paternity action and seek custody rights, however, simply being the biological father is not the end of the inquiry. If the other "father" wants the custody rights, where he has been apparently acting as the father, he may be able to prevail as the child's father. These cases are complicated.
