Biological mother never paid support... now she is suing us
MY stepdaughter lived with us solely for the past 5 years. She is now 17 and has desided to live with her biolgical mother. Her biological mother just served us for child support. We have never recieved any monies from the biolgical mother (my husband's exwife)even though she did not exersize custody or contact for those 5 years. Are we no going to be obligated to pay. The biolgical mother is remarried and has 3 other children by her current husband of 12 years. We have been married for 11 years and have one child. She dosen't work although her husband is employed.

Yes, your husband will have to pay child support. That he did not ask her for child support does not figure in the calculation for ongoing child support. Good Luck, Pat McCrary

Since your comments do not contain a question, I am not sure what you are asking. Suffice it to say that in California, both parents have a statutory obligation to support their children.
