Legal Question in Family Law in California

birth certificate&child support?

im pregnant and im not sure if i should put the father on the birth certificate, i want to but i dont want him to have to pay child support. hes not here for me but he says hes going to be there for his child.

if hes not there for his child i still want him to sign the papers because what if one day when hes older and he wants to find who his father is?

i was thinking to.. what if i gave my son his last name? im not letting him name him but i know he would probably want him to have his last name. i want to give him the fathers last name but i heard if i do then he'll have to pay child support. im confused,

Does he have to be at the hospital when my son is born to sign the birth certificate?

if he did sign the birth certificate and i apply for welfare will the FOB have to pay child support?

if he didnt sign the papers and i still apply for welfare will the FOB have to pay child support? is there any way the county could find out who the father is with out you telling them?

Re: birth certificate&child support?

The County will require you to tell them, under penalty of perjury, who the father is before giving you support. I suppose you could lie and say the name of some recently deceased guy, but if you get caught, you could go to prison. Also, naming a man on a birth certificate does not automatically make him the legal father. A man becomes the legal father by signing a declaration of paternity, by court order, or by marrying the mother before the child is born.
