bothers silent business partner
I've been my bothers silent partner in all his business dealings, my bother and I bought a house(which later quick clamed it to him), then helped him with gas station, and now helped him with large sum of loan amount to build something on the land that he owned. My bother is going through a divorce and now I'm not certain how I can protect my investment. I do have a lean on the new property that he build, however how can I be cretin that it will not be held up or even worse not honored.
Please advise.

You should retain an attorney regarding your interest in your brother's property and the loans to him. There is no simple answer to your question. Quick action on your part will increase the probability of success.
