Legal Question in Family Law in California

I bought my ex-wife out of my retirement pension when we divorced. I am still paying alimony and she has not remarried. The judgement states I will pay support until one of us dies, she remarries or the judgement changes. I am 60 and plan to retire at 63 and will have no income other than my pension. Will the alimony stop once I am only receiving income from the pension that I bought her out of? We have been divorced for 18 years. Thank you for any help.

You need to review the terms of your alimony judgment. If it is permanent and has no termination date, you may be required to pay it until one of you dies or she remarries. In some instances, it may be possible to terminate alimony or modify alimony based upon the changed circumstances of your retirement. It would be prudent to consult with a local attorney.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
