Boyfriend adopting daughter

Can my boyfriend legally adopt my 2 year old daughter if her biological father wants to terminate his rights? I live in California and over a year ago I was told that her biological father could not be relieved of his rights unless there was another person willing to legally adopt her.

You should first get the father to terminate the rights and then you can apply for an adoption with the courts of your boyfriend. A family law facilitator in your local court house can help you file the proper paperwork.

It has been my experience that adoption by a non parent results in the termination of parental rights for both parents. What you are apparently referring to is a step-parent adoption. Such a adoption is allowed only when one parent is married to the individual that wishes to adopt the child.
