Legal Question in Family Law in California

My boyfriend is going through a divorce and custody battle for a year now recently he was working but lost his job do to their more not picking them up he's been looking for a job but hasn't ffound one yet and court is in January if he doesn't have a job and everything else is pretty much in his favor is the judge going to frown soon that even though he could get welfare for them until he gets another job?

Having a job or not is not taken into consideration in awarding custody.
