My boyfriend and I have a 9 month old baby and we live together he is very controlling and aggressive toward me wether the baby is in my arms or in the same room or not he has threatened to kill me and hit me various times his jealousy and anger are out of control he has pushed shoved grabbed and yelled at me he comes at me and calls me names when he is nose to nose with me i want to know how to leave him and have legal and sole custody of my son

You should immediately contact a battered women's shelter and the police to protect you and your baby.
I agree with Ms. Kock, and would add that you should go down to your local family court facility and ask for help getting a domestic violence restraining order issued against him on an emergency ex parte basis.
It does not ever get better, no matter what he promises, and people really do get killed. Protect yourself and your baby. Don't wait for the situation to change.
