Legal Question in Family Law in California

Please Help Bring My Baby Home!!!

I live in CA and my son lives in GA with his father.He has been with him for the last 7 years because I thought I was going to DIE. Now he will only let my son come and visit for the summer time.I want to ask you if I decide to keep my son with me,will I get into any illegal trouble.Am I breaking any laws?Please Help!!I sincerely appreciate any professional input on this subject. Thank you.

In California it is a crime to withhold a child from the parent or other person who has legal custody of the child. Assuming that the father has a court order giving him custody of your son, keeping him here would be a crime. The state where the child and father live would probably be the child's home state. Your best approach would be to contact an attorney in the state where your son lives and discuss your chances of getting a change in custody.

You need to abide by the Courts orders. If you want to change the orders than you will need to get a lawyer and fight to change custody and/or visitation.

If you keep your child without doing the above, they will nail you for parental abduction(kidnapping) which is a felony.
