Brother in Child Support Agony
my brother owes back child support for two kids, in dec of 2003 he was supposed to go to a hearing for modification. well he didn't go and his wife said not to worry she dropped the support order.
He gets monthly statements and since feb of 2004 they have been taking money out of his checks, but it hasn't been applied to any of his statements yet. Now he will have his license suspended in Nov. How can he prove that he has been garnished of wages and can he get any information on what happened on the day he was supposed to attend court.
His ex wife lies, and she never sends any copies of what happened in court or anything. What can he do?

The first thing he can do is take responsibility for his own actions/inactions. If he decides not to go to a court hearing then what does he expect?
In any event, he can file a motion with the court to determine arrearages and modification of support. However, if he files such a motion, he should be prepared to see it through.
