Legal Question in Family Law in California

My brother has full custody of his daughter and son in California. He decided 2 years ago to let the daughter live with her mom in Colorado. These last 2 years my niece has become a heroin addict and has been arrested twice. Does my brother have any say into getting her into treatment or some type of lockup or has he lost his rights. She is on probation in Colorado, she is only 16 years old. My brother never gave up his custody rights in writing, her mother claims she is in weekend rehab but I have seen her facebook and its all about drugs and I'm afraid for her.

He did not lose parental rights by allowing daughter to live with mother, however, court will look critically at his failure to intervene in interim.
