Legal Question in Family Law in California

I have a brother that has suffered from a brain hemorage and has recovered to well conscious state. The issue is that he has requested amongst his siblings that wants a divorce because of the assumed infidelity actions of his significant other. Although that is his request , he may seem at not full strength to take actions. My brother and kids have questioned their mom/wife but she mentioned not to discuss that subject. She has met with her mistress (married man) for at least 3 occasions, so what is the next to do. My brother is starting to go insane of his wifes actions, redirecting the main home phone line to her cell phone so she sees all incoming/outcoming calls. Basically , limiting my communication to them. What to do?
