My brother and his wife would like to give me legal custody of my niece how do I do this?

How can I get gardianship of her?

Your question is too broad to give a good answer in a free BBS service. There is a standard process for obtaining uncontested legal guardianship, and standardized court forms for doing it. You need to either hire an attorney to help you with this, which will not be free but should not run more than a couple of thousand dollars max, should be less, or you can try to do it yourself since it is uncontested. If you want to do it yourself you should go to courtinfo.ca.gov for the forms, and they have links to each of the county courts websites. Find your county and look for the Family Law Facilitator page on the local court's website. They may be able to help you with which forms to use and how to file them, though they cannot give you legal advice or assistance. You have to hire a lawyer for that.
