Legal Question in Family Law in California

Budget expectations for child and spousal support

My wife and I are separated and she's spent most of the past 15 years as a stay at home mom. She recently started back to work, but is only making about 1/4th of my salary. If we get divorced, how much of my salary will I likely need to pay for child support and spousal support. My kids are in grades 6 and 11, so the older one will be in college in less than 2 years.

Re: Budget expectations for child and spousal support

The amount that you pay for guideline child support depends upon the percentage of time the you spend with the children and the net incomes of you and your spouse. Spousal support is calculated after calculating guideline child support. Get a consulation with a family law attorney who can go through the formula with you and make the calculations. I don't see any circumstance under which you would not pay child support when her income is 1/4 of yours. Even if she only has a low per cent of visitation you would probably have to pay her child support. Very probably you would also have to pay some spousal support.

Often in cases such as this paying more in support to allow her to get vocational training will reduce your future chid support, by increasing her income.
