Legal Question in Family Law in California

Business Contract

My husband and I are in financial

crisis. I have spent all my money

trying to dig us out with no resolve.

Currently I have a pending contract

with a publisher. (I'm a new author

seeking publication.) However, I feel I

need to protect myself from my

husband exhausting any new effort

in destroying all of our/my

retirement. If this marriage dissolves

- which is very possible at this point -

how can I protect my new business

adventure and any income from it? I

live in California where everything is

split 50/50.

Re: Business Contract

The business was formed during the marriage and is community property. The income from a book that was written during the marriage would also be community property. You should consult with an attorney immediately and discuss the facts of your case.
