Legal Question in Family Law in California

business with ex wife

I had my own business in air conditioning and since I was married technically she was 1/2 owner. Since my divorce became final but the property and business have not been settled, I created a new a/c business in my name and my mother - new business name, can my ex wife be entitled to ownership in the new business?

Re: business with ex wife

If you took any assets or client's from the old business to your new business then she is entitled to the value of what you took to the new business. There is case law that says the mere change of name to a new business, which it appears that is what you have done, is not a change of the asset. I suggest you get legal help before you create problems for yourself. There are automatic restraining orders that may affect what you have done with the business. Good Luck, Pat McCrary
