In Ca, concerning divorce if Petitioner is not asking for anything and Respondent chooses to file no response, can court still allocate earnings portion from respondent if during brief 10 month marriage only respondent worked?
Background > Petitioner abandoned Respondent 1 and half years ago and there were and are no marital assets, no house, etc. Petitioner only stated in Petition that any assets to be thru discovery should any be ascertained. There are no children in marriage.
Can court still request Respondent to provide asset documentation even though there was none and Petitioner not requesting anything? A MSA is agreed to however nothing yet signed and 30 day limit approaching. If Petitioner does not sign than can court allocate some earnings even of marriage under 1 year and both Petitioner work now?
