Legal Question in Family Law in California

I have sole physcial and legal custody, my ex lives in Florida I live in Ca, he hasnt visited the kids once. I want to move to Nevada, what happens to my custody order? My visitation states he can visit in ca but not leave the state of ca during visitation. Can I just modify visitation or do I have to redo custody as well?

Depending on what your custody order states, you may need to file a motion. If he agrees to visit in Nevada, you can file a stipulation to modify the visitation. If he does not agree then you should file a motion to modify the visitation. Although custody could be placed at issue by him, it is highly unlikely that custody would change, based upon his history with the kids. Good Luck, Pat McCrary
