Reply: California community property

In a general sense, contributions to a 401 K plan between the date of marriage and date of separation are presumed to be community property.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
