Legal Question in Family Law in California

California Community property laws

I am involved in a high profile family law case with a very wealthy married man.

When calculating income, is it true that he can claim only 50% of the entire income on his I & E due to CA Community property laws? What is the law stating community Property and child support?

Re: California Community property laws

There is no provision for deducting 1/2 of the income as community property. Further all of the income in the household would have to be listed on I&E. In my experience the court looks at the pay check stub to determine income and payroll deductions. Family code income provisions require the court to consider the earnings of the paying parent.
