In California, if a couple was not married and has a child who lives full time with the mother and sees the father very little, who technically has custody and does it need to be in writing?

To ensure an enforceable parenting plan, you must file a paternity petition along with a motion for child custody and visitation. You may also wish to consider adding child support to your motion.
