Legal Question in Family Law in California

California - I'm in a divorce case and my support I am paying to my ex-wife just moved from short term support to long term support. I understand I was probably on the hook for her legal fees when the case was in short term support. But now that the case is in long term support and because the reasons for the support are different, does that not mean that she would be able responsible for her own legal fees?

Attorney fees are awarded in family law cases based on a number of factors. The key justification is to ensure both parties have equal access to legal representation. If the spousal support your ex is receiving along with the division of assets and debts justifies in the courts analysis both sides have the resources for an attorney, then your ex may be faced with paying her own fees.

If a judgment has been entered, you owe no attorney fees to her unless that was part of the judgment or ordered by the judge. It has nothing to do with whether you are obligated to pay her support. For further information, visit www.ellifritzlaw.com
