Legal Question in Family Law in California
For California divorce law: In an uncontested agree between both parties, is it best for the Respondent to respond to the to Divorce petition or not? Both cases seem to depend upon a settled and signed agreed from both parties.

If you are not contesting, there is a special form and procedure. If you do not answer the petition, the other spouse can take your default, and have things awarded to her or him by default. Your default prevents you from doing anything until a judgment is entered. At that point, it may be too late and you will be in a bad position. If you are not contesting, do not let your default get taken. It is a wholly different matter.
