Legal Question in Family Law in California
What is up with California family Courts
Hello, I'm not real happy with my wife right now, so I was thinking I would leave and move back east with the kids ages 1 and 3 years. Do I need to tell her or can I just go?
Would I still be responsible for paying any of the bills in California (rent, utilities, insurance)? Can I drop her off my health coverage also? What about taxes and credit card debts? I was considering hiding out until I become a resident, then hit her with the divorce papers and make her deal with it from a distance. We have been living together and married for 10 years. The superior court has a R.O on her that expires in 2005 so I kinda want to do it while I can call the cops in case she makes a fuss about me leaving. You know say I'm scared of her or something file a report and split. What do you think ? Thanks

What you are proposing is criminal and called kidnapping. Do not try to involve a member of the California Bar in such actions. Pat McCrary

Pictures of your kids may end up on milk cartons and a warrant issued for your arrest if you proceed in that manner. If there is a restraining order issued against your wife, how is it that you are still living with her. That would void the restraining order. In any event, it would appear that you would be granted custody of the children. Do it right for you and your children, call me directly at (619) 222-3504.
