Legal Question in Family Law in California
Cal-Pers Retirement
As part of a dissolution of marriage, I was awarded part of my ex-husbands Cal-Pers Retirement Fund. My husband's attorney is responsible to file the Quadro with the court and has not done so. I have been inquiring for via phone & in writing for 8 months, no one will respond to my inquiries. The document is ready to be signed by a judge & filed in the court, but no one from the attorney's office will proceed with this. I have offered to help. What can I do?

from the facts given, its clear that your ex's attorney has no real incentive to file or check on the filing status of the qdro form with the court and/or your ex's employer. given this assumption, you clearly might want to look into retaining an attorney yourself specifically to follow thru on this in your behalf so you can start receiving your benefits promptly. we currently are efficiently representing a client in your similar boat here and would gladly and aggressively assist you as well in this unfortunate situation. if you would such assistance, please email me directly with your contact information for a free case evaluation/consultation.

You can ask the court to set up a hearing on the matter to get things moving and ask the court to intervene. Call if questions. 800-685-6950

If the document has been filed with the court, you have to wait for it to cycle through. If the attorney has refused to file it with the court, you can possibly check with the plan, and they may have a copy to provide you with so you can file it with the court. There are other possibilities including court intervention and or sanctions against the attorney.
I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
