Legal Question in Family Law in California
Cap on frivolous litiginous child support filings?
The ex-wife is using the court as stage to exact revenge by filing for increased child support then setting out by any means to make me the bad guy (not paying bills, etc). Clearly this is not the case and I have had to work hard to prove otherwise. Is there a cap a judge can impose on frivolous litiginous child support filings in the future? My child will reach age 18 in the near future. Thanks.

If the filings are frivilous you can request attorney's fees and costs under Family Code Section 271. The judge may restrain future filings, however, that would be a rare instance. Good Luck, Pat McCrary
