Is there a case reference
I bought a house before marriage and my husband (boyfriend at the time) put down part of the down payment. I have always made the payments from my seperate account and we were only married for 9 months prior to seperation. He has been in the house for 2 YEARS while we were going through the custody portion of the trial. Meanwhile I am still having to make payments to save my credit and can't get him out.
Any case, he is claiming Moore/Marsden....I purchased prior to marrage, I am the only one on title, I have made all of the payments, and we were only married for 9 mo. prior to seperation. Can he use this? Is there a case reference for me?

When you say you made payments from your separate account, do you mean this account had money in it that came from a separate property source, or is this an account into which you deposited your paychecks during marriage? There are a lot of issues here and a lot of missing information. You really should get a consultation from a local attorney.

The reference is Marriage of Moore and Marriage of Marsden. That is why it is called Moore/Marsden. You will need an attorney on this. It seems that it hasn't worked out well without an attorney so you should change strategies. Good Luck, Pat McCrary
