Cease of Domestic Partner Relationship
I recently broke up with my fiancee on November 22, 2006. We have lived together for five years. I found out he was cheating on me and ended the relationship. I moved out of our apartment on November 25, 2006. He stated that I could have the apartment and all furnishings. I told him he needed to leave our apartment today. He says that he has until tomorrow since he paid 1/2 of the rent. He says that I have to pay him for tomorrow. I have not been living there for the past 7 days. Do I have the right to ask for a refund to my portion of the rent? Also, as a couple of 5 years in California, is there a common marriage law? Do I have any rights to Alimony? Please let me know.

California has no statutory provision for a common law marriage. The only rights you would have would be the result of an agreement. It is unlikely that he would agree to any financial or other benefits to you.
