how is the per cent to the non PERS spouse figured in a California divorce

One half of the community property interest generally is awarded to the non-participant spouse. The community property interest is that portion of the benefits which were earned during the marriage. However, the value of other community property received by the non-participant spouse which is greater than that received by the participant spouse may be offset against the award.
