Legal Question in Family Law in California

What are my chances of moving & getting custody of my son?

Avery-2 year old son, no custody established

Lindsay-wife as of (6/28/01)-on & off drug (crank) addict for 5 years (off 4/99-11/00)

She left me 12/00.

During 12/00, 1/01, and 2/01 she saw our son 10% of time

During 3/01-11/01 she saw him1% (her choice)

Before marriage through 3/01 we planned to move to Santa Cruz so I could go to UCSC for film school for 2 years to get BA & then move to LA for my career.

I was accepted-UCSC for fall 2001-in 3/01 due to my wifes leaving I instead decided to move to LA in 8/02.

I told my wife this so she would have time to plan for it & she said she would try to move w/me.

7/01 she signed a paper stating that I can move to LA as long as I do it before 2003 & even if she doesn't move she can't force me to stay here 600 away. She now says I conned her to sign the document by telling her that I would get back together with her (which is what she wanted in 7/01, regardless of that fact that she abused me and I had to pry a knife out of her hand once)

2 weeks ago Lindsay went to rehab for 1 day, then quit & moved to her moms.

Shes been off drugs for 2 weeks & seeing Avery.

She now refuses to move to LA or give me full custody.

What are my chances of being able to move with my son?
