name change without adoption

Is it legal to change my sons last name to match mine? My oldest son does not belong to my husband, and his biological father contested adoption. I want him to have the same last name as the rest of us before he starts school. Currently he has my maiden name. I need to know if I can do this before I go waste a bunch of time and money. Thank you
