Name Change for a child
My child has been using my husband's last name for several years even though he is not adopted. Now that he is almost 18 he does not want to go by his birth given name, how does he change his name without adoption? Or can he just go by the name he has been using? Or does he have to to go back to his birth given name?

He can legally use any name he wants. If he wants to make it official he can file a petition with the court. Any lawyer can do it for him or you can get the forms from the court clerk and try it yourself.

Doing a name change yourself is a pretty simple process, especially since your son is nearly 18. You could probably use a document prep service successfully, or, as the other lawyer said, just pick up the forms at the court and do it yourself.
