change of custody after ''abandonment?''

Hello, the father and I share joint physical and legal custody. He disappeared from my child's life 3 years ago. I'd like to file for full physical and legal custody. Will the court grant me this? We don't know where he is at, the D.A.'s office garnishes child support from his work but when my child writes him at the address they have, he does not respond.

You can file a motion to give you the custody orders that you request. He can be served by mail at that address. If her letters do not come back to you that would mean that someone is getting them. Good Luck, Pat McCrary
