Legal Question in Family Law in California
Change of Custody
My husband has a 4yr. son with x-girlfriend. He just found out that the girlfriend's 16 year old cousin is the caretaker for the 4 year old and 1 year old twins (girls). This kid hasn't attended school since he was 14 years old. He has some type on mental/learning disability and he's also a homosexual. My step-son told my husband that this kid touches his private parts! Can my husband ask the court for a change a custody? My husband has told the mother to change the careprovider. She ignores his concerns!

Re: Change of Custody
This is a matter of grave concern and as the previous attorney stated, you should seek appropriate intervention. Child protective services should be contacted to intervene as well as in regards to custody, seek an ex parte order to temporarily change custody pending further investigation.
Re: Change of Custody
You should do more than just request a change of custody. Report this conduct ot child protective sercices. It may be more than just the one son that is in danger from the child.
In regard to the custody change you should request an ex parte order changing the custody of the boy immediately.
