Change of custody

My 16 yr old stepson is moving in with us May 31,2003. His

mother will not fight the change of custody.We have had

custody of his 14 yr old sister since 1994. What form do we

file with the courts to make the change legal. Would like to

file something that would make the change legal without

appearing in court as we live out of town. She is on AFDC

for my stepson and her daughter and will need to notify the

county so we can stop paying child su

I would use a Stipulation & Order To Modify the underlying custody and visitation orders. You should also consider addressing the child support issue. If both parties agree and sign, and the form is properly prepared, it can be mailed in and you will never have to see the inside of a courtroom.

You should contact the AFDC office and notify them that the children are living with you. Until you can get a stipulation signed be sure that you have witnesses that the children are living with you. If there is a child support case open in the county in which you are living contact the local child support enforcement officer, and notify them that the children are living with you.
