Name change after a divorce
My maiden name is Roberts. I was married & divorced in LA county in 1984. I have been married and divorced since them and now live in San Bernardino county. I want to go back to my maiden name and I am unsure where to file my FL395. Can I request a name change using my last divorce case # or do I need to go to LA county and use my first case #? Karen

You know the fact that you are in LA county actuals makes your question which is generally a simple one more complicated. LA county seems to have its own way of doing things which is generally different than anything in Northern California. However, I believe you could use either case number since it is a name you have used before. When a name change is done using a name which the party has never used before it is done under its own case number. However, when the name is one the party has used before the procedure is a little less formal. I believe you could use either court case, however since you could have changed your name back to your madien name during your last dissolution I would use the last dissolution. However, it also depends on long it has been since your dissolution. In order to make sure call the family facilator's office at the county court and ask them what they think. They tend to know the county procedures in & out and probably will know exactly what you should do.
