Legal Question in Family Law in California

Change in Judgment

Last year my divorce was finalized. At that time I was ordered to pay spousal support. Since then my financial situation has changed and I have also added a dependant, my daughter. What steps do I need to take to have my case re-reviewed in hopes that I can pay a lower amount in monthly spousal report? Do I need to see another attorney or can I complete the documents myself? What legal forms do I need to complete IF I can do it myself? Thanks for your help.

Re: Change in Judgment

You need to file an OSC to Modify Spousal Support. Only an attorney can give legal advice - specifically, will your changed circumstances warrant a reduction in support. If there is a basis, a competent lawyer will help you get the necessary information in front of the judge. Also, there are specific requirements regarding time to file and serve the OSC which must be met. If you do not choose to hire an attorney, however, there are self help clinics in some courts that offer assistance with information and forms.
