Re: change of legal seperation to divorce

If you are legally separated, there is a judgment stating that you are legally separated. If this is the case you will have to file a new petition for dissolution of marriage.

File another one, this time calling it "amended" and checking the box for dissolution.

In a general sense, if you have a Judgment for Legal Separation and want to become single, then you need to file a Petition - Dissolution. If you do not have a Judgment - Legal Separation, then you are not legally separated.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

You need to file an amended Petition seeking dissolution of marriage. If a judgment of Legal Separation has already been entered then you need to file a whole new petition.
