Legal Question in Family Law in California

name change

i was married and divorced in North Carolina and have since moved to California. It seems as though returning to my maiden name should not be so expensive and difficult. It seems returing to the name on your birth certificate should fall under a federal thing, just like getting your passport. In CA I will have to pay $269 plus the cost to publish my request for name change in the newspaper. Is there any easier cheaper way????? NC says I have to reside there to get it done, even though that's where I was divorced. Please give me good news.

Re: name change

You should contact the attorney that did your divorce and ask about the possibility of amending the divorce decree to change your name, and the cost involved. In California most family courts would allow such action to be taken, unless the decree is quite old.

In California it is legal to use a name without formally changing your name through a court proceeding. Unless the purpose for the change is fraudulent etc.
