Legal Question in Family Law in California
Name Change for a minor.
My daughter is 10 years old. About 4 years ago her father walked out, had a few visits with her then married a non kind woman. They stalked us called us names, and made our life pretty miserable. He fought me for custody adn was told by the judge that he was not fit to be a father at this point in time. I won legal and physical custody, and was given a court order stating he can have no contact with her what so ever.
He has never even attempted to.
I still sent pictures to his home of her growing up and the new wife, would rip them up and leave them in front of my house. Needless to say he has not been a father now for 4 years. My daughter has been using my last name in school for 3 years now, and we wold like to make it legal. I am taking him to court to get the name changed. Do I stand a challenge, Or should this be simple, as he is not a father anymore? This will be in California.

If he objects you will have to present evidence to show that the change in name is in his best interest. Save the torn up pictured.
