Name change for minor whose father's not on birthcertificate

My daughter was married had an affair, got pregnant and ex husband's name is on the birthcert. Found out child is not from ex thru DNA. Now daughter remarried wants to change minors name to new husbands name. Can that be done w/o biodad's conscent. New husbands name same as my maiden name can we use that as reason.
