Name change for minor

My son and ex girlfriend have a child 8yr.

The ex married and wants to change her daughter's last name to the new hushband. The name on the birth certificate lists her maiden name and my son as the father. My son is active in her life. Can she do this without consent and what are the legal precautions if she does?

Re: Name change for minor

To legally change her name mom would have to get a court order. She would be required to give father notice of the hearing. Retaining an attorney to represent him should be seriously considered.
