Name Change for minors

I am the custodial parent of two children, 12 and 15. They wish to change their last name to mine. Can they start using my last name before it is done legally? And would I need to obtain the assistance of an attorney to do this because their father who lives out of state might contest this even though he does not have much of a relationship with them? Would I have a problem with the judge ruling in our favor because the father might contest it?

they can use any name you want them to use with or without going to court to change it. you dont need an attorney but can use one if you want. opposition by the father could make it harder to get.
