name change

since i just received sole legal and physical custody of my son, does this mean i can change his last name without having to go through the trouble of asking his ''father'' for permission.

No, it does not necessarily mean that. But there is no reason why you cannot call the child and have his school and others call him whatever you wish, even if it is not his "legal" name. It is conceivable that the court would grant a name change, but it is also conceivable the court will not. The Father is still the Father, and that does not change even if he does not have the right to make legal decisions concerning the child. He still has some fundamental constitutional rights.
