can he change my sons name with out my permission

I was not married when I had my son and his BF was not in this state when he was born so his name is not on the birth certificate. He lives in Illinois and has been ordered to pay support and now wants to change my sons last name to his. He has no contact with him. Can he do this with out my permission? Can he petitions the court in Illinois? will I have to appear there? what are my rights to keep his name the same as mine?

He can bring a paternity action and request a name change. A request does not mean that the judge would grant the request. It could not be in Illinois unless the child was conceived there or lives there. It should to be brought in the state in which the child lives. Good Luck, Pat McCrary
