Change of Venu

How do I file a change of Venue? My ex husband is taking me back to court to lower child support. Our Divorce was filed in Kern County. I would like the proceedings transfered to Riverside County where I reside with our Daughter. Is this possible? Also, I am unable to make the Court Date that he set. He will not change it. How can I change the court date?

Prepare a written response to the motion. Be sure to include full financial information and visitation information. Provide proof of your current residence and the time that you have lived there. It is common for parents living out of the area to appear by telephone. If you can appear by telephone make that request.

Open a child support with the local department of child support service. They will file a child support case in the county in which you reside. Current child support law favors filing for support in the county in which the child resides.

You need to draft a motion to ask the court to order the venue be changed. A variety of factors would be taken into consideration though. Where the parties live is one of the main factors.
