Legal Question in Family Law in California

Change of Venue in the middle of a divorce

Hi there, I am moving to Santa Rosa from the Roseville area after 3 months of going through the courts and twice through mediation. My divorce is only halfway over and I want to file for a change of venue. I am currently in the Placer County Court system and want to transfer my divorce to Sonoma County. Is this possible? I do not know if this is common. I have a two year old son and this divorce process in Placer County has been awful. I do not want any future decisions to be made by the Placer Courts. It is notorious for corruption and their reputation proceeds them. How can I move my case without the courts denying it. Hardship for me? We have joint custody and joint legal as well thanks to our mediator. My husband also has been a drug user and skipped a drug test, and the judge did not blink an eye and he got away with it even getting more time with our son. He has 34% (increased after he skipped his drug test) and I have 66%.

Thanks so much for your time. Carina

You should file a motion to transfer the court to a new court system. The court will weigh the evidence and decide whether to grant it or not, after hearing from the other party.

Good luck, as always please contact a lawyer in your area before taking legal action.
