Changing a Childs legal name

I was wondering. If both the biological parents would like to change the name of their child. What are the legal steps? The son's mother was married to the step-father at the time of birth. My son took the step-fathers last name. A divorce has happened and now the mother and I would like to change my sons last, and middle name. If the step-father agrees can we do all this out of court and without Lawyers.

It does not break any law just to use the new name but if you want it official you have to go to court. Ask the court clerk for the forms you need to file a name change petition.
